Perhaps Gunns lawyer was too busy telling all the councils that that Gunns really does own the island when he should have been giving the tippex a workout on the community side of the PMAA?

does the PMAA2007 have any relationship to Common Law?  does common/Case Law deal with any issues similar in nature to the pipeline issue?

Having their pipeline knocked-back because of the legislation they allegedly helped draft, has given the Gunners new opportunities to practice interesting ways of hanging from their own petards.

Gunns is a PRIVATE company operating in Tasmania on the same principles that caused the sub-prime fiasco that has shaken the world—Sheer Greed.

There are the assets - find a way of controlling, monopolising and profiting from them at the least possible cost and with the least benefit to the owners. Buy the Government and infiltrate every public office and department in the State. Use tax-payers money to promote yourself and your objectives. Live like a leech on the public purse and use the money to reward your cronies. Ensure that you get preferential treatment over all other private companies and the people. Have opposition declared illegal and be prepared to sue. Use intimidation as weapon and use bully-boys to carry out your dirty work.
Then there is corporate law which can be used in your favour. Here a corporation can assume the rights of a person, plus all the rights of a company - a definite advantage where litigation between the two is concerned, especially when one considers the additional punch that corporate wealth can bring to a case. Here the playing field is decidedly uphill for the average individual or even a public institution. An even bigger problem lies in the fact that the corporations, because of their wealth and power, can buy influence and have laws specially written or tailored to their needs; even changed if a judgement goes against them. This avenue is not open to the individual. All people are supposed to be equal under the law, but a corporation is not a people; and because of this, it is a lot more equal than the average person, or even a whole community, come to that. In many instances, where it has sufficient wealth, it is definitely above the Law and allows the proponents to tread heavily on all other people’s rights.

The pulp mill has been a long and clever strategy, not without its rewards for the players, even though events seem to have overtaken the end game.
