The media in general appears happy to play down this latest court challenge (Examiner Page 17).  Perhaps the failure of the previous two challenges leads them to the presumption that this new one is nothing to get too excited about.  I would imagine though that Gunns Ltd would be a little more nervous about this one because it is about the DECISION not the PROCESS.  Remember there is little doubt that Turnbull was forced by Howard to fashion an approval out of the information gathered by the Chief Scientist.  Turnbull knows the mill is a bad idea as does Garrett.  Common sense would suggest that all modelling should be complete before approval.  It is interesting that Garrett is “getting advice” about the matter but stands by the approval.  What if the advice suggested that Turnbull’s decision wouldn’t stand up in court?
